DOES THE INCIDENT SCENE MEET LOCAL STANDARD?
Winter or summer holiday, the most common investigation centres on a claim made under English law via the EU Package Tour Regulations. Heard in an English Court, it is judged against what constitutes reasonable skill and care defined by the relevant local standard applying in the resort on the date of the incident. This is not the same as assuming the case is heard in a local Court under local law, illustrated by the following example:
